Content moderation just became a federal requirement

The Jewish American Security Act crossed my feed this morning. The interesting bit is not the motivation, it is the mechanism. The bill requires online platforms to moderate content that encourages violence or discrimination against Jewish communities. Not suggests. Requires. Content moderation has always lived in a strange legal space. Platforms moderate because they want to, not because they have to. Section 230 protects them whether they moderate heavily or not at all. This bill changes that calculus for one category of content. If it passes, platforms must build systems to detect and remove content encouraging violence against Jewish people. Failing to do so becomes a legal liability. The technical challenge is not trivial. Detection at scale means automated systems, which means false positives and edge cases. A meme referencing historical events could trigger a filter. A news article about antisemitism could get flagged. The bill does not specify what counts as sufficient moderation, which means platforms will err on the side of over-removal to avoid penalties. This sets a precedent. If Congress can mandate moderation for one protected category, it can mandate it for others. Every group with enough political backing could lobby for similar requirements. The result is not more nuanced moderation. It is stricter, blunter systems applied to avoid legal risk. The enforcement question matters too. Who decides if a platform is complying? The bill mentions the Attorney General. That means federal oversight of what gets removed from social media. The moderation decisions that used to be internal platform policy become subject to government review. I am curious how this plays out in practice. Platforms already moderate antisemitic content under their own policies. Making it a legal requirement does not change what gets removed. It changes who is responsible when something slips through.
